Overview

These Terms of Service govern your access to and use of picalta’s websites, applications, AI image-generation tools, and related services.

picalta is an independently operated software product. These Terms are between you and the independent operator of picalta.

By accessing or using picalta, you agree to these Terms. If you do not agree, you must not use the service.

1. Eligibility and Accounts

You must be at least 18 years old and legally capable of entering into a binding agreement.

picalta may require you to sign in using an authorized Google Account. You are responsible for maintaining the security of your Google Account, devices, and access to picalta.

You must provide accurate information and must not impersonate another person or use an account without authorization.

2. The Service

picalta uses artificial intelligence to help users transform product images into e-commerce visual assets, including product images, lifestyle scenes, feature images, marketplace visuals, measurement graphics, and related creative materials.

Features, generation models, credit costs, availability, and supported platforms may change as the service evolves.

3. Credits and Payments

picalta may provide free, purchased, promotional, or bonus credits.

Credits:

• May be used only within picalta
• Have no cash value
• Cannot be transferred or resold
• Are deducted according to the generation action shown in the service
• May be subject to different promotional conditions

Purchased credits do not expire and remain available until used, unless your account is terminated for violation of these Terms or applicable law requires otherwise.

Credits are charged only for successfully completed generations. Failed, interrupted, or uncompleted generations release the credits reserved for those outputs.

Payments are generally non-refundable except where required by law, in cases of duplicate charges, or where picalta expressly agrees otherwise. An approved or payment-provider-processed refund may reverse the credits associated with that purchase.

Promotional or bonus credits may be modified, withdrawn, or subject to additional conditions.

4. User Content

You retain ownership of product images, reference materials, text, trademarks, and other content you upload to picalta.

You grant picalta a limited, non-exclusive, worldwide license to host, copy, transmit, process, modify, and display your content only as reasonably necessary to:

• Operate the service
• Generate requested visual assets
• Store and display generation history
• Prevent abuse and maintain security
• Provide customer support
• Comply with legal obligations

You represent that you own or have all necessary rights and permissions to upload and use your content.

You must not upload confidential information, personal data, copyrighted materials, trademarks, photographs of individuals, or other content unless you have the legal right and necessary permissions to do so.

5. Generated Output

Subject to these Terms and payment of applicable fees, as between you and picalta, you may use generated output for lawful personal or commercial purposes to the extent permitted by applicable law and third-party provider terms.

Because artificial intelligence systems may generate similar or identical content for different users, generated output may not be unique.

picalta does not guarantee that generated output:

• Is copyrightable
• Is free from third-party rights
• Is accurate or error-free
• Meets the policies of Amazon, Shopee, TikTok Shop, Shopify, Temu, or any other platform
• Is suitable for a particular commercial, advertising, regulatory, or legal purpose

You are responsible for reviewing generated output before publishing or using it.

6. AI Limitations and Product Accuracy

AI-generated images may contain inaccurate text, product details, dimensions, colors, packaging, logos, labels, people, environments, or visual claims.

You must verify that generated content accurately represents your product and does not create deceptive, unsupported, medical, safety, performance, environmental, or regulatory claims.

picalta is a creative tool and does not provide legal, advertising, regulatory, medical, or platform-compliance advice.

7. Prohibited Use

You may not use picalta to:

• Violate any law or regulation
• Infringe intellectual property, privacy, publicity, or contractual rights
• Produce fraudulent, deceptive, or misleading product representations
• Impersonate individuals or organizations
• Create unauthorized endorsements, certifications, awards, reviews, or official approvals
• Generate illegal, abusive, exploitative, or harmful content
• Bypass security, usage limits, or credit systems
• Reverse engineer, scrape, resell, or interfere with the service
• Use automated systems in a manner that places unreasonable load on the service
• Train competing models or services using picalta systems or proprietary materials without permission

8. picalta Intellectual Property

picalta and its licensors retain all rights in the service, including its software, interfaces, workflows, visual systems, branding, trademarks, documentation, and underlying technology.

These Terms do not grant you ownership of picalta’s software, brand assets, or proprietary systems.

9. Third-Party Services

picalta may rely on third-party authentication, payment, hosting, analytics, and artificial intelligence providers.

Your use of certain features may also be subject to the terms and policies of those providers. picalta is not responsible for third-party services outside its reasonable control.

10. Suspension and Termination

picalta may restrict, suspend, or terminate access where we reasonably believe that:

• You violated these Terms
• Your activity creates legal, security, fraud, or abuse risks
• Payment is overdue, disputed, or fraudulent
• Continued access could harm picalta, its providers, or other users
• Suspension is required by law

You may stop using picalta at any time and may request account deletion in accordance with our Privacy Policy.

11. Service Availability

We aim to provide a reliable service but do not guarantee uninterrupted or error-free availability.

Generations may fail, take longer than expected, or become temporarily unavailable because of maintenance, demand, network conditions, model-provider limitations, or circumstances beyond our control.

12. Disclaimer of Warranties

To the maximum extent permitted by law, picalta is provided on an “as is” and “as available” basis.

picalta disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and results.

13. Limitation of Liability

To the maximum extent permitted by law, the operator of picalta, its contractors, and its service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, lost data, loss of goodwill, or business interruption.

The aggregate liability of the operator of picalta arising from the service will not exceed the amount you paid for picalta during the 12 months immediately preceding the event giving rise to the claim.

Some jurisdictions do not permit certain limitations, so portions of this section may not apply to you.

14. Indemnification

You agree to indemnify and hold the operator of picalta harmless from claims, losses, liabilities, damages, and expenses arising from your content, your use of generated output, your violation of these Terms, or your infringement of another party’s rights.

15. Governing Law and Disputes

These Terms are governed by applicable law. Any mandatory consumer rights available to you remain unaffected.

Courts with competent jurisdiction under applicable law will resolve any dispute, unless the parties agree to another lawful process.

16. Changes to These Terms

We may update these Terms as picalta evolves. We will update the “Last updated” date and provide additional notice where legally required.

Continued use after an updated version becomes effective constitutes acceptance of the revised Terms.
